Terms of Use

Last updated: 26 July 2026

These terms apply when you use The Witty Badger website, buy digital files from our shop, or use our mobile apps. By using any of them, you agree to these terms. If you don’t agree, please don’t use them.

Who we are

The Witty Badger is operated by Frazer Barnett, a sole trader in the United Kingdom. You can reach us at hello@thewittybadger.co.uk.

Our digital products

We sell digital embroidery design files — there are no physical goods and nothing is shipped. After a successful payment we email you download links, and you can re-download your purchases from your account. Please make sure your email address is correct so you receive your files.

Orders and payment

Your licence to use the files

Design files are licensed to you, not sold. What you may do with them depends on the licence you buy (personal or commercial). Please read our full licensing terms for details. In all cases you may not resell, share, or redistribute the design files themselves.

Downloads and delivery

Download links are valid for a limited time (typically 72 hours) and can be re-issued from your account or via our downloads page. Because the products are delivered digitally, delivery is effectively instant once your payment completes.

Refunds

Our files are digital and download immediately, so by completing your purchase and starting a download you agree that your statutory 14-day right to cancel no longer applies. If a file is faulty, corrupted, or not as described, contact us at hello@thewittybadger.co.ukand we’ll put it right. Nothing here affects your legal rights.

Our apps

Our mobile apps are also covered by these terms, together with Apple’s standard App Store terms. Any in-app purchases are handled by Apple. See our Privacy Policy for how the apps handle data.

Acceptable use

Please use our website, shop and apps lawfully and don’t attempt to disrupt them, misuse them, or infringe our intellectual property. All content, branding and designs are owned by or licensed to The Witty Badger.

Liability

We provide our products and services with reasonable care and skill. To the extent permitted by law, we aren’t liable for indirect or unforeseeable losses. Nothing in these terms limits any liability that can’t be limited under UK law.

Governing law

These terms are governed by the laws of England and Wales.

Changes to these terms

We may update these terms from time to time. When we do, we’ll update the “last updated” date above.
